Code § 32-03-09.1, property-damage recovery generally follows the lesser of the reasonable cost of restoration or the amount the property’s market value was diminished by the loss. North Dakota courts have applied this framework to damaged vehicles, which can significantly limit a separate claim for residual diminished value after repairs have been completed.

North Dakota doesn't set a fixed percentage that forces an insurer to total your car — that 75% figure some drivers have heard of (N.D. Cent.
