Rhode Island is a fault-based state — drivers carry liability insurance, and an at-fault driver's insurer is generally responsible for the other party's vehicle damage, including diminished value. Rhode Island law sets specific, actively-updated rules for total loss vehicles: Rhode Island General Laws § 27-9.1-4 defines the fair-market-value percentage that triggers a total loss (85% as of 2026), and regulation 230-RICR-20-40-2.8 requires insurers to base your cash settlement on documented, verifiable market data. Rhode Island also gives you a statutory right to an independent appraisal under § 27-10.4-1 if you disagree with the number. An independent, itemized appraisal gives you the evidence to use that process — before you sign a release.
