Washington is a fault-based state: personal injury protection (PIP) coverage must be offered on every auto policy, but a named insured may reject it in writing under RCW 48.22.085, which is why Washington operates as a traditional tort/fault system rather than a no-fault one for property damage. In practice, that means diminished value claims are most commonly pursued against the at-fault driver's liability insurer, since your vehicle's lost resale value after an accident is part of the damage that driver's insurance is responsible for. Washington doesn't use a fixed percentage to define a total loss the way some states do — RCW 46.04.514 instead asks whether repair costs plus salvage value make your vehicle "uneconomical to repair." What Washington does regulate closely is how your cash payout has to be calculated: WAC 284-30-391 requires documented, itemized data behind any settlement offer, and confirms that an appraisal process is available only if your own policy already includes that provision. An independent appraisal gives you the market-based evidence to challenge a number that doesn't reflect your vehicle's real condition, mileage, or options.
